The basis of Qualified Immunity is illegal. The 1982 SCOTUS went by an illegal revision of the law, they had no reason to believe that the law was written any other way. The law in question, Section 1983, had been changed by a single unnamed secretary in 1874, when they were charged with copying the 1871 Congressional Record into the Federal Register.
